After my article in the Rheinische Notarzeitschrift, I have now also written an article in the Deutsche Notarzeitschrift (DNotZ) on the subject of “Notarial register of estates”. However, it is about another aspect, namely the so-called right of the person entitled to the compulsory portion to draw on the estate. Specifically, it is about the question of what rights the person entitled to the compulsory portion has within the framework of the creation of the register and what limits exist in this respect. I have found some of the statements made so far to be contradictory and confusing. With my contribution I have tried to keep some order. However, many individual questions in this regard are still unresolved; I have therefore developed my own suggestions in this article, which have not yet been clarified by the courts.
