Article in the Rheinische Notarzeitschrift (RNOTZ) on the topic “Notarial register of estates”

I have written an article in the Rheinische Notarzeitschrift (RNotZ) on the subject of “Notarial register of estates”. The article is printed in issue 6 on page 260.

There I took the view that the notary should also be responsible for affirmation in lieu of oath (§ 260 Paragraph 2 BGB), which is unfortunately not seen in this light in practice at present. In my opinion, a change in the law is necessary here, so that the compilation of the register and the affirmation in lieu of oath complement each other properly and the procedure is accelerated.
